Karl Marx did not come up with a Sociology of Law but influenced by the happenings in his society during his time, much of his writings provide a valuable pool of knowledge for contemporary Marxists to build on.

As such, contemporary Marxists have developed two notions of law which would be the backdrop against which the law-society relation from a Marxist point will be evaluated.

The Marxism theory of law-society relations can be seen from an instrumental point of view (also known as strong version of determinism) and the structural point of view (also known as soft version of determinism/ relative autonomy).

The instrumental school of thought is based on the argument that the ruling class in the society determines the legal system; how and which laws should be enacted, enforced and what type of penalty is to be administered.
