L Ltd is a corporation which owned a large shopping centre in the course of construction. A Pty Ltd was appointed the leasing agents for the centre and prepared a glossy brochure advertising the shopping centre for lease. One of the claims in this brochure is that there will be two large anchor tenants in the property operating within five months of opening and that there will be vehicular access to two major roads which pass the property. T had a conversation with D, a director of L Ltd, when he returned the letter of intent. T asked D how the leasing of the shopping centre was going. D replied:-
?We are finding tenants slowly but they will all be there on the day. There?s nothing to worry about.?
At that time D knew that the prospects of leasing all the shops in the centre were poor.
Just prior to opening, T signed a formal lease. When the shopping centre opened only half of the shops in the centre were leased.
About a month after opening day, T discovered that one of the anchor tenants has decided to go to another major shopping centre nearby and that there will only be vehicular access to one of the major roads which pass the property.
T approached L Ltd about these matters and received the response that ?the situation is regrettable but beyond our control?
Advise T of his rights and remedies under the Australian Consumer Law.
